Terms of Service
Contract
This Customer Agreement (this "Agreement" or "Contract") is made between CSBA, ("CSBA", "Computer Science and Buisness Administation", "we", or "us") and you, the customer of this business and user of CSBA Rentals (as such term is defined below). You have indicated your acceptance of this agreement by using this site and/or associated services, for example, the membership and messaging services, and the listing, posting, searching, viewing of the property and/or unit listings. We reserve the right to change the terms and conditions of this agreement at any time without prior notice. Such changes and optionally their effective date (if not immediately) will be posted on this web site. You agree to review any changes to this agreement and, if such changes are not acceptable to you, immediately terminate your use of CSBA Rentals and terminate this agreement as provided herein. Your continued use of CSBA Rentals after the effective date of such changes will constitute your acceptance of the changes. If you no longer wish to be bound by this agreement, you must (i) have remained in compliance with each of the terms of this agreement at all times prior to termination, (ii) provide us with written notice of your intention to no longer be bound by this agreement and (iii) immediately terminate your use of CSBA Rentals.
Product and/or Service
The product and/or service you are using and are agreeing to terms of use of said product and/or service is CSBA Rentals. CSBA Rentals is defined as the product and/or service you received from CSBA and it includes, but is not limited to, use of this site and/or associated services, for example, the membership and messaging services, and the listing, posting, searching, viewing of the property and/or unit listings, or in any way accessory files that contribute towards its function in any way. You are not allowed to use this product and/or service in any way not explicitly stated by CSBA.
Free for Approved Use
This product and/or service is provided free of charge, for approved uses. You must be using this site in good faith, and may not use it to post illegal, incorrect, misleading, libelous, fradulent, discriminatory, or nonexistent listings or messages. You may also not use this site in any way for harassment, unsolicited messaging, including but not limited to spam or advertisements for unrelated products. You may also not use it in any way illegally or that would in any way damage the reputation of CSBA, any of its employees, owners, or affiliates. In addition, CSBA reserves the right at any time to change the approved uses, deny use in a specific case, or otherwise refuse use or service without prior notification or reason, in any case.
Support
This is a freely distributed product, and as such, Support is provided only on a limited, voluntary basis and is not guaranteed, and can be terminated at will by CSBA, at any time, without prior notice, and without consent from you or any other party. Additionally, there is no money-back guarantee of any kind and as stated below in "NO WARRANTY" we will not and can not be held responsible for anything relating to the use of this product and refunds are entirely at our discretion and are not guaranteed in any way.
Reliability and Content
This product and/or service can not be guaranteed reliable, and we cannot guarantee any particular amount of site availability, functionality, or accuracy. The content displayed on this site is also not guaranteed in any way to accurate, factual, or even existent. The content available is not representative of the opinion or policy of CSBA, or any of its affiliates, and we cannot be held responsible for any content posted on this site. We can also not be held responsible for any damages, emotional or physical, lost revenue, or any disruptions in service or content whatsoever. Additionally, we can not be held responsible for any lost or erroneous content or personal information. By using this product and/or service you agree that you are doing so at your own risk and any damages, losses, or any loss of privacy is your sole responsibility, and that CSBA will not be held liable in any case.
No Warranty
CSBA Rentals is provided "as is" without warranty of any kind, either expressed or implied, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose.
In no event is CSBA, its owners, employees, members, contributors, or affiliates, to be held liable for damages as the result of viewing, using, listing, posting, messaging, copying, or distributing CSBA Rentals. By using this product and/or service, you agree that you are doing so at your own risk and any damages, losses, or any loss of privacy is your sole responsibility, and that you agree to indemnify CSBA in all cases.
ALL CONTENT, SERVICES AND PRODUCTS OF CSBA OR AVAILABLE ON THIS SITE AND ALL CONTRIBUTORS, OWNERS, EMPLOYEES, OR AFFILIATES, INCLUDING, BUT NOT LIMITED TO, THEREOF IS PROVIDED "AS-IS" WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE INCLUDING BUT NOT LIMITED TO, ANY WARRANTY THAT THIS PRODUCT AND/OR SERVICE WILL MEET YOUR REQUIREMENTS, THIS PRODUCT AND/OR SERVICE AND ANY ASSOCIATED CONTENT AND/OR LISTINGS WILL BE FUNCTIONAL, ACCURATE, EXISTENT, AVAILABLE, SECURE, OR ERROR-FREE, OR ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR ANY PARTICULAR PURPOSE OR NONINFRINGEMENT. YOUR USE OF THIS PRODUCT AND/OR SERVICE IS ENTIRELY AT YOUR OWN RISK. IN NO EVENT SHALL THE COPYRIGHT OWNER OR ANY CONTRIBUTORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES; LOSS OF USE, DATA, OR PROFITS; OR BUSINESS INTERRUPTION) HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY, WHETHER IN CONTRACT, STRICT LIABILITY, OR TORT (INCLUDING NEGLIGENCE OR OTHERWISE) ARISING IN ANY WAY OUT OF THE USE OF THIS SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. IF THE TERMS OF USE STATED IN THIS CONTRACT IN ANY WAY VIOLATE ANY PROVISION OF APPLICABLE LAW, YOU MAY NOT USE THIS PRODUCT AND IN ALL CIRCUMSTANCES YOU HOLD AND TAKE FULL RESPONSIBILITY TO ENSURE THAT YOU DO NOT USE THIS PRODUCT ILLEGALLY. BECAUSE SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF IMPLIED WARRANTIES, ASPECTS OF THE ABOVE EXCLUSION MAY NOT APPLY TO YOU. IN SUCH JURISDICTIONS, ANY WARRANTIES WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.
